Terms of Service

These Terms of Service govern your use of the Decly application and the Decly website at https://declyai.com.
1. Acceptance of Terms
By creating a Decly account or using Decly, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Decly.
2. Decly and its purpose
Decly is an educational and communication-support tool that helps users practice declarative language and find calmer ways to communicate. Decly generates suggestions; it does not deliver therapy, treatment or clinical services.
3. Eligibility
You must be at least 18 years old, or the age of majority where you live, to create a Decly account. Decly is intended for adults — parents, caregivers, educators and professionals — who use it on behalf of themselves or the people they support.
4. Accounts
You are responsible for the accuracy of your account information, for keeping your credentials secure, and for activity that occurs under your account. Notify us at support@declyai.com if you believe your account has been compromised.
5. Acceptable use
You agree not to:
- Use Decly for any unlawful, harmful, abusive or deceptive purpose.
- Attempt to access accounts, data or systems that are not yours.
- Interfere with, overload, scrape, reverse engineer or circumvent limits, security or usage quotas in the service.
- Present Decly output as professional medical, psychological, behavioral or therapeutic advice.
- Resell or redistribute Decly access in a way not permitted by us.
Decly may be used personally and in professional, school and clinic settings. Organizations wishing to deploy Decly across a team should contact us about a pilot or team arrangement.
6. AI-generated content
Decly uses third-party AI models to generate suggestions. AI output can be inaccurate, incomplete or unsuitable for a given situation, and identical prompts may produce different results. You are responsible for reviewing suggestions and deciding whether and how to use them.
7. Educational and communication-support disclaimer
Decly is an educational and communication-support tool. It is not a medical device and does not diagnose, treat, cure, or prevent any medical condition. Decly does not provide medical, psychological, behavioral, or therapeutic advice. Information and suggestions provided by Decly are for educational purposes only and should not replace advice from a qualified healthcare or other appropriate professional.
Every child, family, and situation is different. Decly's suggestions may not be appropriate for every situation. Caregivers and users are responsible for deciding whether and how to use the suggestions provided by Decly.
8. User content
You retain ownership of the content you enter into Decly. You grant us a limited license to store, process and transmit that content as needed to operate the service (including sending prompts to our AI provider) and to provide support. You are responsible for having the right to enter any information you submit, including information about other people.
9. Profiles, favorites, history and Family & Groups
Decly lets you create profiles, save favorites and keep history. Members may sync this data across devices. Family & Groups lets eligible members create private groups and invite others. You are responsible for who you invite to a group and for the content you place in it.
10. Shared content
When you share a profile or favorite with a group, a snapshot of that content becomes visible to that group's members. Removing a share stops future access but does not undo what others have already seen or copied. Do not share content you are not permitted to share.
11. Member and Member Pro subscriptions
Decly offers a free tier and paid memberships (Member and Member Pro) that unlock additional features such as higher usage allowances, cross-device syncing and Family & Groups. Features, limits and pricing for each tier may change; we will not reduce a paid benefit for your current paid period without notice.
12. Stripe billing
Payments are processed by Stripe. By subscribing, you authorize recurring charges to your payment method at the then-current price until you cancel, plus applicable taxes. Decly does not receive or store your card details. Promotion codes, where offered, apply only as described at redemption.
13. Cancellation and refunds
You may cancel at any time; your membership remains active until the end of the current billing period and does not renew after that. Payments are generally non-refundable except where required by law or the rules of your app store or payment platform. If something went wrong, contact support@declyai.com and we will review it in good faith. Cancelling a membership does not delete your account.
14. Intellectual property
Decly, including its software, design, branding and content (other than your content), is owned by Decly and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable right to use Decly in accordance with these Terms.
15. Feedback
If you send us feedback, ideas or suggestions, you grant us the right to use them without restriction or compensation.
16. Third-party services
Decly relies on third-party providers for AI processing, authentication and database services, payments, email delivery and hosting. Their availability and terms are outside our control, and links to third-party sites or communities are provided for convenience only.
17. Service availability and changes
We may modify, suspend or discontinue features at any time, and the service may be unavailable for maintenance or reasons beyond our control. We do not guarantee uninterrupted availability.
18. Disclaimer of warranties
Decly is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that output will be accurate, appropriate or effective.
19. Limitation of liability
To the maximum extent permitted by law, Decly and its team will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, goodwill or profits, arising out of your use of Decly. Our total liability for any claim relating to Decly will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
20. Suspension and termination
We may suspend or terminate an account that violates these Terms, creates risk for other users, or is used to abuse the service. You may stop using Decly at any time.
21. Account deletion
You can request deletion of your account and associated data at any time — see Account Deletion. Requests are processed manually and are not instantaneous; information we must legally retain may be retained.
22. Changes to these Terms
We may update these Terms as Decly evolves. We will update the effective date above and, for material changes, provide notice in the app or by email. Continued use after changes take effect means you accept the updated Terms.
23. Governing law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules, and the state and federal courts located in Texas will have exclusive jurisdiction, except where mandatory local consumer law provides otherwise.
